1. General Provisions

1.1. This Digital Goods Policy (“Policy”) governs the sale and delivery of digital products via the LeadFilter™ platform.

1.2.Merchant of Record: VIGO ONLINE GROUP acts as the Merchant of Record (MoR). We are the legal seller of the digital goods to the End-User (“Purchaser”). VIGO is responsible for payment processing, invoicing, and technical delivery.

1.3.Scope: This Policy applies to all intangible goods sold on leadfilter.ca, including Quiz Access, Digital Reports, Qualification Results, and Service Credits.

1.4.Acceptance: By initiating a transaction, the Purchaser agrees to be bound by this Policy, the Terms of Service, and the Privacy Policy.

2. Nature of Digital Goods & Delivery

2.1. Intangible Status. Products sold on LeadFilter™ are strictly digital, non-physical goods provided via electronic transmission.

2.2. Moment of Delivery. For legal and transaction dispute purposes, a digital good is deemed fully delivered and consumed at the exact moment when:

  • Access is granted via a web interface (redirect after payment); OR
  • A secure link or access code is transmitted to the email address provided by the Purchaser; OR
  • Credits are applied to the Purchaser’s account balance.

2.3. Server Logs. LeadFilter’s internal server logs serve as the definitive, non-disputable proof of delivery.

3. Refund Policy & Right of Withdrawal

3.1. Strict No-Refund Policy.

Due to the immediate and irrevocable nature of digital delivery, ALL SALES ARE FINAL. VIGO ONLINE GROUP does not offer refunds, returns, or exchanges once delivery has commenced.

3.2. Statutory Waiver (EU/UK/Global).

By clicking “Pay” or confirming the purchase, the Purchaser expressly:

  • Requests immediate performance of the contract (immediate access); AND
  • Acknowledges that they lose their right of withdrawal (cooling-off period) once the download or access has started, in accordance with Article 16(m) of the EU Consumer Rights Directive and equivalent international laws.

3.3. Consumer Dissatisfaction.

Refunds are NOT permitted for reasons related to subjective satisfaction, including but not limited to:

  • Disagreement with the advice, results, or conclusions provided in the Partner’s content;
  • Failure to use the product after purchase (“Change of mind”);
  • Technical inability to access the product due to the Purchaser’s local device limitations;
  • Accidental purchase where access was successfully granted.

3.4. Exceptions.

A refund may be considered at VIGO’s sole discretion only in the event of:

  • Double Billing: A verified duplicate transaction caused by a payment gateway error.
  • Non-Delivery: A verified technical failure of the leadfilter.ca platform where the product was never delivered to the Purchaser.

4. Content Responsibility (Seller vs. Creator)

4.1. VIGO (Seller). VIGO facilitates the sale and ensures the technical delivery of the digital file or access link.

4.2. Partner (Creator). The Partner (Quiz Creator) is the sole author of the content. The Partner bears full legal responsibility for the accuracy, legality, and quality of the information, advice, or results contained within the digital good. VIGO does not verify or endorse the Partner’s content.

5. License and Usage Rights

5.1. Limited License. Upon purchase, VIGO grants the Purchaser a limited, non-exclusive, non-transferable license to access and view the digital content for personal, non-commercial use.

5.2. Restrictions. The Purchaser is strictly prohibited from:

  • Reselling, sub-licensing, or redistributing the content;
  • Using the content for commercial purposes without express written permission;
  • Copying the intellectual property (text, logic, design) of the Quiz.

6. Disclaimer of Warranties

6.1. All digital goods are provided on an “AS IS” and “AS AVAILABLE” basis.

6.2. VIGO ONLINE GROUP expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the results of any Quiz or Assessment will meet the Purchaser’s specific requirements or expectations.
