This Acceptable Use Policy (“AUP”) defines the rules, restrictions, and prohibited activities when using LeadFilter™, including all web interfaces, quizzes, internal CRM, APIs, questionnaires, forms, and data processing tools (“Service”).

By using the Service, the User (“Partner,” “Client,” or “Lead”) confirms that they have read, understood, and agree to comply with this policy.

1. General Principle & Merchant of Record Status

1.1. LeadFilter™ is a technology platform for creating digital questionnaires and monetizing content.

1.2. VIGO ONLINE GROUP acts as the Merchant of Record (MoR) for transactions processed via the platform. This means VIGO bears the risk of chargebacks and compliance violations. Therefore, we enforce strict content moderation to protect our payment infrastructure (Stripe).

1.3. The Service may only be used in a lawful, ethical, and bona fide manner.

1.4. The Company reserves the right to immediately suspend or terminate any account found in violation of this policy without prior notice.

2. Prohibited Content Categories

Partners are strictly prohibited from uploading, publishing, distributing, or selling access to any content that falls into the following categories:

2.1. Illegal Content

  • Content that violates the laws of Canada, the EU, the USA, or the User’s jurisdiction.
  • Content that promotes illegal acts, including drug use, theft, or violence.
  • Content that violates data protection regulations (GDPR, PIPEDA, CCPA, COPPA).

2.2. Stripe Restricted Businesses (High Risk)

Since VIGO processes payments, Partners cannot use the platform to sell or promote:

  • Financial Services: Investment advice, crypto-currencies, binary options, pyramid schemes, or “get rich quick” programs.
  • Regulated Goods: Pharmaceuticals, pseudo-pharmaceuticals, nutraceuticals, alcohol, tobacco, or weapons.
  • Adult Content: Pornography, sexually explicit materials, or services.
  • Gambling: Lotteries, bidding fee auctions, sports forecasting, or odds making.

2.3. Intellectual Property Infringement

  • Selling content (text, images, videos) that you do not own or have a license to use.
  • Using trademarks of third parties (e.g., “Instagram”, “Google”, “Government of Canada”) in a way that suggests false affiliation or endorsement.

2.4. Misleading & Deceptive Claims

  • False promises of results (e.g., “Guaranteed Visa Approval,” “Earn $10k in 2 days”).
  • Impersonating government agencies or official bodies.
  • Hiding the price or subscription terms from the End-User.

3. Prohibited Actions and Abuse

The User of the Service undertakes not to commit:

3.1. Technical Violations

  • Attempts to hack, reverse engineer, or compromise the security of LeadFilter™.
  • Interference with the operation of servers, scripts, APIs, or IP filters.
  • Automated data scraping (crawling) without permission.

3.2. Payment Abuse

  • Card Testing: Using the platform to validate stolen credit card numbers.
  • Money Laundering: Creating fake quizzes to transfer funds between accounts.
  • Chargeback Fraud: Encouraging users to dispute valid charges.

3.3. Data Abuse

  • Selling Lead databases collected via LeadFilter™ to third parties (Data Brokering).
  • Exporting data to jurisdictions without adequate data protection laws.
  • Uploading stolen or purchased data lists into the LeadFilter™ system.

4. Sensitive Data (Special Categories)

4.1. The Service permits the collection of sensitive data (health, race, political views, trade union membership) ONLY if the Partner has a valid legal basis (GDPR Art. 9) such as explicit consent.

4.2. Prohibited Requests: Partners are strictly prohibited from requesting:

  • Full credit card numbers (PAN) within the quiz fields (payments must go through the official Stripe checkout).
  • Government ID numbers (SIN, SSN, Passport Number) unless strictly necessary and legally authorized.
  • Passwords to third-party accounts.

4.3. VIGO reserves the right to delete any Quiz that collects sensitive data without adequate security or legal justification.

5. Enforcement & Consequences

5.1. Right to Intervene. VIGO ONLINE GROUP has the absolute right to:

  • Remove or block any Quiz that violates this AUP.
  • Suspend Partner Payouts if we suspect fraud or AUP violations.
  • Report illegal activity to law enforcement or payment processors (Stripe).

5.2. Forfeiture of Funds.

If an account is terminated due to a violation of this AUP (especially for fraud or illegal content), any accrued Payouts may be forfeited to cover potential fines, chargebacks, or legal costs incurred by VIGO.

6. Indemnification

As stated in the Terms of Service, the Partner agrees to indemnify and hold harmless VIGO ONLINE GROUP from any fines, damages, or claims arising from the Partner’s violation of this Acceptable Use Policy.
